1. Never sign a VSO Immediately (You have negotiating power)

In the Netherlands, an employer cannot simply fire you without cause. To avoid lengthy court proceedings or UWV approval, employers usually offer a Settlement Agreement (Vaststellingsovereenkomst or VSO).

A VSO is a voluntary contract to end your employment by mutual consent.

  • The first offer is rarely the best offer. Employers expect you to negotiate severance pay, notice periods, and extra compensation.
  • There is a 14-day reflection period. Under Dutch law (Art. 7:670b DCC), you have the right to revoke your signature within 14 days after signing without giving any reason.

3. What Happens to Your 30% Ruling?

If you qualify for the 30% ruling, losing your job puts this tax benefit at risk.

To transfer your 30% ruling to a new employer, the gap between your official employment end date and your new employment start date must not exceed 3 months. Negotiating a longer notice period in your VSO is often the key to saving your 30% ruling status.
